By accepting these Terms of Use and submitting material to the site, you agree that:
1. TCP Forum is open to all registered members, and user comments and opinions are welcomed and encouraged. Users are free to post their thoughts or feedback, to exchange ideas with Department of Health staff and with one another.
2. To make sure that this site is a safe place for all users, and for legal reasons, there are Terms of Use and House Rules for using this site. Terms apply to all people who want to access or post comments on the site.
3. You may only access and use this site if you agree to be legally bound by these Terms of Use and the House Rules. If you do not agree to be legally bound by these Terms of Use and the House Rules, please do not access and/or use the site. You will be deemed to have accepted these Terms of Use and the House Rules if you commence or continue to access and use this site, and you will continue to be bound by these Terms of Use and the House Rules for so long as you access or use this site.
4. The Department of Health may make changes to the site, including these Terms of Use or the House Rules, at any time. You agree that you will be legally bound by the updated or amended Terms of Use and House Rules from the first time you use the site after the updated version is published on the site.
5. You are welcome to post comments, ideas and discussion points on any theme or topic, provided that you comply with these Terms of Use and the House Rules. You can respond to the original post or to comments from other users. If you would like to add a new discussion topic, simply click on the 'New Topic' link and follow the prompts. Your suggested topic will be reviewed by the site Administrator. If it complies with these Terms of Use and the House Rules, your topic will appear on the site as soon as possible. The Department of Health may choose not to post your topic, and may choose to edit or remove your topic, as outlined below.
6. The Department of Health may publish on the site any material uploaded, posted, emailed or otherwise submitted by you (User Generated Material). This includes text, illustrations, photos, graphics, audio, video or other material generated by you. It also includes any documents or attachments that you upload with your post.
7. All User Generated Material published on the site remains published at the sole discretion of the Department of Health. It may remain on the site for an indefinite period or may be removed at any time, in the sole discretion of the Department of Health.
8. 8. User Generated Material reflects the individual opinions or views of the relevant user. The State of Victoria and the Department of Health do not endorse any advice or opinions contained in any User Generated Material. The HAnet Disclaimer for this site forms part of these Terms of Use.
9. The Department of Health may monitor, moderate or exercise editorial control over User Generated Material and reserves the right but not the obligation to assess or examine the User Generated Material after it is submitted or after it is posted on the site.
10. The Department of Health will edit User Generated Material or remove User Generated Material from the site if, in the opinion of the Department of Health, that User Generated Material:
a. is incompatible with any Department of Health or Victorian Government policy; b. is misleading or false, or impersonating another living person; c. is potentially libellous or defamatory; d. is abusive, threatening, harassing, hateful, insulting, offensive, obscene, blasphemous or racially vilifying; e. is of nuisance value, inappropriate, off topic or vexatious; f. is spam, promotes a product or commercial service, or solicits business; g. compromises your privacy or that of someone else, or breaches confidentiality; h. is deliberately provocative of other community members.
11. All intellectual property rights in this site (except User Generated Material) are owned by the State of Victoria.
12. All intellectual property rights in User Generated Material are owned by the user that contributes the User Generated Material to the site, or, if not owned, are used under licence by that person for the purposes of contributing the User Generated Material to the site.
13. In relation to any User Generated Content that you contribute to this website in which you or a third party has a moral right, you consent and will procure the consent of any third party, to the State of Victoria and the Department of Health doing or omitting to do anything that, but for this consent, would constitute an infringement of your moral rights in the material (as defined by the Copyright Act 1968). This includes reproducing, publishing, performing, transmitting, exhibiting, adapting, altering or in any way changing or using the material that you submit to or post on the site:
i. with or without attribution of authorship; j. with or without any other materials comprising copyright; k. with or without any other text, data, sounds or images; l. with no title, the same title or any other title; m. in any medium or context, in any way that the State of Victoria or the Department of Health sees fit.
14. In submitting your User Generated Material to the site, you grant to the State of Victoria and the Department of Health a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, edit, modify and exploit any User Generated Material that you submit to or post on the site, including but not limited to:
n. Editing the User Generated Material to remove any content described in paragraph 10 above; o. Using the User Generated Material for reference purposes in the development of public policy related to ageing and aged care; p. Reproducing the User Generated Material in reports, publications or promotional material about this site.
15. In submitting your User Generated Material to the site, you warrant to the Department of Health and the State of Victoria that:
q. you have the right to post the User Generated Material on the site and the right to grant the licence outlined in paragraph 14 above; and r. by publishing your User Generated Material on this site and using your User Generated Material in accordance with the licence in paragraph 14, the Department of Health and the State of Victoria will not be infringing the intellectual property rights of any third party. This means that if you post or upload any material that you have not written yourself, you have obtained all necessary permissions or licences to upload or post that material on the site.
16. You consent to the Department of Health collecting and storing your IP address for security purposes. See our Website Privacy Statement for more information about how we protect and manage information about our users.
17. You indemnify the Department of Health and the State of Victoria against all loss, legal fees, damages and other expenses incurred or potentially incurred as a result of a breach by you of these Terms and your submission of any content to the site. This means that if a third party makes a claim against the State of Victoria or the Department of Health that relates to the material that you have posted on, submitted to or uploaded to the site, you agree to reimburse the State of Victoria and Department of Health for any loss or damage that they suffer as a result of the claim. Examples of when this might occur include: if the material you post is inaccurate or defamatory; or if the dissemination of the material constitutes a breach of privacy or an infringement of the intellectual property rights of a third party.
18. The Department of Health reserves the right to edit, reject or delete any comments that have breached these Terms of Use or the House Rules.
19. The Department of Health retains the right to deregister or suspend the membership of any member whose behaviour does not comply with these Terms of Use or the House Rules.

TCP Forum Rules

TCP Forum is an online forum which can be used to share information on your experiences, new research, policy development, projects, the latest news, upcoming events or ask advice from network members. As long as the topic area is program related, at a local, jurisdictional or national level, then feel free to post. If you wish to talk about treatment, management of diseases or illness, or other health related or personal issues, seek advice from health professionals.
For legal reasons and to make sure the TCP Forum is welcoming to all users:
- Keep your contributions polite, civil, tasteful and relevant. This is a public space, so please write and behave accordingly, and remember that people of all ages read and contribute to this site.
- Do not post messages that are unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, homophobic or racially offensive.
- Post in English only. Posts containing languages other than English may be removed.
- No impersonating. Impersonating someone (including Department of Health staff members) is unacceptable.
- You many not describe or encourage activities that could endanger the safety or wellbeing of others.
- Ensure that any quoted text is attributed to its original author.
- No spamming or flooding. Don't repost the same message, or very similar messages, more than once.
- Do not post your own or anyone else's personal identifying information. This is for your own safety and that of everyone who uses this service.
- Comments may not tip shares or make recommendations on investments.
- No multiple memberships. Please do not create more than one membership. It is unfair to the other users who only have one membership and abide by the posting and recommendation limit.
- We reserve the right to remove comments that we consider break any of the rules or the spirit of the rules and to block individuals from commenting.
- Please don't abuse the complaints system. It exists to enable visitors to alert the moderators about content that breaks the above rules. The complaints system cannot be used to complain about other programmes or services. Please do not use the complaints system to alert us to spelling mistakes, opinions you disagree with and so on. Anyone who abuses the complaints system repeatedly may have their account suspended.
- All comments and posts will be moderated by department staff after they have been posted. Language filtering programs will be used to block certain words.
- No advertising, promotion of commercial products or services, or posting of web links (URLs) that don't directly relate to mental health promotion. If you have an event to promote, simply post a new event via the New Event link; a moderators will approve this as soon as possible.
Very important: If you see a comment that you think is inappropriate, let us know by clicking on the 'report this post' button.
The Department of Health may close comments on a topic or post if we think the discussion has become irrelevant or out-of-date.

TCP Forum administration and moderation

The TCP Forum Administrator is responsible for the registration of members, approval of event posts, and administration of general website content.
TCP Forum Moderators are responsible for checking user-generated content to network topics to make sure there are no clear breaches of the Terms of Use or House Rules. If this occurs, we may change the content slightly so that it complies, or in rare cases, delete the posting. Either way, we'll let you know if this happens.
